Elixir Privacy Policy
1. Introduction
This privacy policy is about how Elixir Coaching collects, processes, stores and shares client’s and prospective client’s data.
This Privacy Policy relates to personal data collected by the Elixir Coaching via the Elixir Coaching Wix website and application forms either hosted by the Wix website or GoogleForms or forms sent via email or WhatsApp. It also relates to emails, messages, WhatsApp messages, WhatsApp calls and telephone calls. Any personal data collected by the Elixir Coaching is used in accordance with UK data protection legislation.
Users should be aware that if they access other websites, using any links provided, these are outside our control. If they provide personal data to other companies, the privacy policies of those companies determine the uses to which that information is put and the Elixir Privacy Policy will no longer apply.

Elixir Coaching complies with the principles of the Data Protection Bill 2017 in accordance with General Data Protection Regulations (GDPR).

The data we collect from members is the data required to provide professional services to members, communicate with members and validate and verify the legitimacy of clients. The data held by Elixir Coaching is collected at the time of application by members for Discovery Calls, submission of queries or emails, application to join the Coaching programmes or online training or when they download digital products provide on the website whether free to download or chargeable.
We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page.
We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile.
When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only.
We collect such Non-personal and Personal Information for the following purposes:
To provide and operate the Services;
To provide our Users with ongoing customer assistance and technical support;
To be able to contact our Visitors and Users with general or personalised service-related notices and promotional messages;
To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services;

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PC/ Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Data may be shared internally with administrators for the purpose of verifying payments and refunds.

Your interaction via the Elixir website hosted by Wix, via query form, via email, via voice or video call, messenger services or WhatsApp, signing up to join a Coaching programme or an online course or downloading digital materials is an optional process. By engaging with Elixir Coaching, members consent to receive information relating to the activities of Elixir in the form of newsletters, regulatory updates, upcoming seminars, webinars, events, training, special offers and information relevant to the services provided.
By providing personal data to Elixir Coaching, users consent to the processing of such data by the Elixir Coaching as described in this Privacy Policy.
6. Opting out of communications
Opt out mechanisms are in place. Users can choose to opt out of communications at any time by following the request to opt out process on the communication.
7. Links to Third Party Websites
This Privacy Policy applies solely to the personal data collected by Elixir Coaching and does not apply to third party websites. Elixir Coaching is not responsible for the privacy policies of third party websites. Elixir Coaching advises users to read the privacy policies of other websites before registering any personal data.

Additionally when communication either with Elixir Coaching or with our clients via website groups. Any abusive or discriminatory behaviour may result in services being withdrawn.

Elixir Terms of Use for Health & Wellbeing Information, Products and Materials

These Terms of Use apply to all digital health and wellbeing information, products and materials that are available for download or access from Elixir Coaching via our website www.elixircoachingmelissadevere.com (here after to be known as ‘Elixir Coaching website’).
The client must read these terms carefully before accessing, purchasing or downloading any Digital Product. By the act of accessing or downloading either via purchase or for free, or using any of our Digital Products; the client confirms that they have read, understood, and agree to be bound by these Terms of Use.
The ‘client’ refers to anyone interacting with information or services provided by Elixir Coaching, regardless or whether they are interacting on a basis or paid for services and or products; or if they are receiving these for free. The client is defined based on their interaction and they may or may not have aa contract with Elixir Coaching.
1. Nature of Information
Digital Products
All digital products sold or supplied for free on the Elixir Coaching website (including but not limited to eBooks, guides, PDFs, and downloadable resources) are non-tangible, digital goods delivered electronically.
2. Informational Use Only
All information, products and materials provided by Elixir Coaching, through coaching sessions, coaching materials, online courses, digital products, website content and materials (www.elixircoachingmelissadevere.com), newsletters, promotions and other other correspondence; are for general informational and educational purposes only.
They are not intended to be a substitute for professional medical advice, diagnosis, or treatment.
The client should always consult their GP, physician, or other qualified health professional before starting any new health, nutrition, or fitness program or making changes to their existing healthcare and wellbeing regimen.
If the client has or suspects they have a medical condition, they should seek medical advice immediately.
Digital materials are not a substitute for working one-2-one with health coach or other health and wellbeing practitioner.
Online digital materials provided by Elixir Coaching, serve to sign post the client to ideas and information for which they need to do their own research to make a decision about implementing their changes.
Good nutrition, exercise and other modifiable lifestyle factors, can support the body’s natural defences, may optimise the functioning of the body systems and may increase resistance to disease. However, no claim can be made about the efficacy of any advice given.
All changes are implemented at the client’s risk and they are responsible to conduct appropriate risk and impact assessments.
If the client choose to try any medications, supplements, herbal medicines, homeopathic remedies, other alternative remedies, or restrict certain foods from their diet - ENSURE that it is done so in conjunction with the appropriate medical professional, including and not limited to their GP. Any health conditions the client may have, prescription medication, over the counter medication, supplements or other remedies can cause serious interactions which is why it is important for the client to talk to their GP, physician before implementing changes to their health and wellbeing.
3. Personal Responsibility
By using our health and wellbeing information, products and materials, the client agrees to take full responsibility for their own health and wellbeing decisions.
The client acknowledges that any changes they make based on information from Elixir Coaching, is made voluntarily and at their own risk.
The client understands that outcomes may vary from person to person, and Elixir Coaching makes no guarantees about the effectiveness or results of any guidance provided.
4. No Liability and Limited Liability
To the fullest extent permitted by law:
Elixir Coaching accept no liability for any loss, injury, or damage incurred by the use of our information, products and materials .
Elixir Coaching shall not be held liable for any indirect or consequential losses, or any decision the client makes based on the content of our health and wellbeing information, products and materials.
Elixir Coaching’s liability for any claims arising from the use of our health and wellbeing information, products and materials shall be limited to the purchase price paid for the product.
5. Intellectual Property
All content from the coaching sessions, coaching materials, online courses, digital products, website content and materials, newsletters, promotions and other other correspondence; (including but not limited to text, graphics, layout, and design) is the property of Elixir Coaching and Melissa Anne de Vere-Loots, registered Sole Trader and owner and founder of Elixir Coaching, and is protected by UK copyright and intellectual property laws.
The client may use the content for personal, non-commercial purposes only. The client may not copy, share, resell, or distribute any part of the information, products and materials without prior written permission from Elixir Coaching.
6. Refund Policy
Due to the nature of digital downloads, the Right to Cancel (Cooling-Off Period) is waived by client, by acknowledging that downloading/streaming begins immediately and they lose the right to cancel once it starts. Consent is provided by the client via the download form.
Hence once the download for a digital product has been started, or the product accessed via other means such as but not limited to attachments sent via email or materials sent via post, no refunds will be issued.
Unless the digital product is defective, corrupted, or not as described, please contact us within 14 days of purchase at melissaannedever@gmail.com and we will provide a replacement product or refund as appropriate and required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and Consumer Rights Act 2015.
7. No Right to Cancel Once Download Begins
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, digital content is not refundable once the download or streaming has started because:
The client is informed before purchase that they will lose their 14-day cancellation right once the download starts.
The client gives their explicit consent to this by agreeing before downloading.
By purchasing a digital product or downloading one for free, from Elixir Coaching, the client acknowledges and agrees to the following:
The client will have access to the digital content once they initiate and complete the download process
The client consents to this immediate supply of the digital product.
The client understands that by giving this consent, they waive their legal right to a 14-day cancellation and refund period.
Hence once the download for a digital product has been started, or the product accessed via other means such as but not limited to attachments sent via email or materials sent via post, no refunds will be issued. Unless the product is faulty or does not match the description, in line with their rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and Consumer Rights Act 2015.
8. Updates and Changes
We reserve the right to update or amend the content of any Guide at any time without prior notice. The client purchases most current version of the product that is live the our website, at their time of their purchase. The client will not automatically have the right to access a later version of a product released after they have downloaded their purchase of it.
9. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.

Terms and Conditions – Elixir Coaching
By engaging with Elixir Coaching: including coaching sessions, online courses, and digital products, you agree to the following terms and conditions
1. Charges and Payment
1. The charges for the coaching/online course/digital products (the Charges) shall be as described by Elixir Coaching (Melissa Anne de Vere-Loots) either via email or published on the website.
2. All fees for coaching services, online courses, or digital products must be paid in full and in advance and cleared before:
- the coaching sessions commence (or the client / attendee will not be able to commence coaching) or
- the online course or digital products are downloaded and / or accessed.
3. Prices for all services and products are listed clearly at the point of purchase.
4. Elixir Coaching reserves the right to update pricing at any time.
2. Cancellations and Refunds
2.1. Coaching
2.1.1. Coaching & 14 day consumer protection rights
You have the right to cancel your purchase of Coaching within 14 days of payment (part or full), in accordance with consumer protection laws. Elixir Coaching required you to provide notice in writing at any time up to 14 days after the payment of your deposit or first instalment or when settled in a single, full and final payment: the earliest date of these three is the date from which the 14 days should be calculated. Notice is to be provided to Melissa Anne de Vere-Loots, owner and founder of Elixir Coaching to the email:melissaannedevere@gmail.com.
In this circumstance, the Attendee / Client will receive a full refund. The refund will be paid into the account that the initial purchase was made.
2.1.2. Coaching Packages - Break Clause
In addition to your statutory right, Elixir Coaching offer a further opportunity to cancel coaching packages. An Elixir ‘Coaching Package’ is defined as a group of 3 of more coaching sessions sold as package. Either the Client or Elixir Coaching may initiate a break in the coaching agreement after one month from the date of the first coaching session.
In the event of termination under this clause, a pro rata refund will be issued based on:
- The total number of sessions included in the package.
- The number and type of sessions already attended or delivered.
- This clause applies regardless of who initiates the cancellation, and the refund amount will be calculated fairly to reflect only the unused portion of the package.
Requests to activate the break clause must be made in writing with at least 7 days’ notice, unless otherwise agreed in exceptional circumstances. Notice is to be provided to Melissa Anne de Vere-Loots, owner and founder of Elixir Coaching to the email:melissaannedevere@gmail.com.
2.1.3. Coaching Exceptions
If coaching has already commenced during the 14-day period, a pro rata refund will be issued based on the number of sessions used and the length of the sessions attended.
2.2 Online Courses
2.2.1. Online courses & 14 day consumer protection rights
You have the right to cancel your purchase of an online course(s) within 14 days of payment (part or full), in accordance with consumer protection laws. Elixir Coaching required you to provide notice in writing at any time up to 14 days after the payment of your deposit or first instalment or when settled in a single, full and final payment: the earliest date of these three is the date from which the 14 days should be calculated. Notice is to be provided to Melissa Anne de Vere-Loots, owner and founder of Elixir Coaching to the email:melissaannedevere@gmail.com.

2.2.2 Exceptions
Unless the Online course is corrupted and cannot be accessed or is not as described, then please contact us within 14 days of purchase at melissaannedever@gmail.com and we will provide a replacement or refund as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and Consumer Rights Act 2015.
2.3. Digital Products
2.3.1. Digital Products & 14 day consumer protection rights
If a digital product has already been downloaded, no refund will be issued. This is in accordance with the Elixir Digital Download Policy, and waiver of your right to a cooling off period, which you would have consented to at the time of purchase of the digital product. This is due to the fact you will posses the digital product from the tome of time load.
2.3.2. Exceptions
Unless the Digital product is defected, corrupted or is not as described, then please contact us within 14 days of purchase at melissaannedever@gmail.com and we will provide a replacement or refund as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and Consumer Rights Act 2015. Any applicable refunds will be paid into the account that the initial purchase was made from.
3. Copyright and Intellectual Property
All content provided by Elixir Coaching: including coaching materials, course materials, recordings, and digital products; is protected by copyright.
Clients may not reproduce, distribute, or share any content without express written permission. Purchase of services or products grants a non-transferable, non-exclusive license for personal use / non-commercial purposes only.
You may not copy, share, resell, or distribute any part of the information from: coaching sessions, coaching materials, online courses, digital products, website content and materials, newsletters, promotions and other other correspondence; without our prior written permission.
4. Appropriate Professional Behaviour
All clients and representatives of Elixir Coaching are expected to maintain professional conduct at all times during coaching sessions, group discussions, or communications.
Abusive, offensive, or disruptive behaviour will result in immediate termination of services without refund.
5. Updates and Changes
We reserve the right to update or amend the content of any Guide at any time without prior notice. It is your responsibility to check for the most current version if re-downloading or referencing the material.
6. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.

In the event of termination under this clause, a pro rata refund will be issued based on:
- The total number of sessions included in the package.
- The number and type of sessions already attended or delivered.
- This clause applies regardless of who initiates the cancellation, and the refund amount will be calculated fairly to reflect only the unused portion of the package.
Requests to activate the break clause must be made in writing with at least 7 days’ notice, unless otherwise agreed in exceptional circumstances. Notice is to be provided to Melissa Anne de Vere-Loots, owner and founder of Elixir Coaching to the email:melissaannedevere@gmail.com.
6.3. Coaching Exceptions:
If coaching has already commenced during the 14-day period, a pro rata refund will be issued based on the number of sessions used and the length of the sessions attended.

These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.

Elixir Terms of Use for Health & Wellbeing online courses

These Terms of Use apply to all health and wellbeing online courses that are available from Elixir Coaching via our website www.elixircoachingmelissadevere.com (here after to be known as ‘Elixir Coaching website’).
The client must read these Terms or Use carefully before accessing the online courses either via purchase or for free; the client confirms that they have read, understood, and agree to be bound by these Terms of Use.
The ‘client’ refers to anyone interacting with the online courses and information provided by Elixir Coaching, regardless or whether they are interacting on a paid basis or for r free. The client is defined based on their interaction and they may or may not have aa contract with Elixir Coaching.

All online courses sold or supplied for free on the Elixir Coaching website are non-tangible, digital goods delivered electronically. Online courses are self directed and accessed by the client, via the Elixir Coaching website, in conjunction with information that is provided on the Elixir website.

All information provided by Elixir Coaching, through online courses, website content and materials (www.elixircoachingmelissadevere.com), newsletters, promotions and other correspondence; are for general informational and educational purposes only.
They are not intended to be a substitute for professional medical advice, diagnosis, or treatment.
The client should always consult their GP, physician, or other qualified health professional before starting any new health, nutrition, or fitness program or making changes to their existing healthcare and wellbeing regimen.
If the client has or suspects they have a medical condition, they should seek medical advice immediately.
Digital materials are not a substitute for working one-2-one with health coach or other health and wellbeing practitioner.
Online digital materials provided by Elixir Coaching, serve to sign post the client to ideas and information for which they need to do their own research to make a decision about implementing their changes.
Good nutrition, exercise and other modifiable lifestyle factors, can support the body’s natural defences, may optimise the functioning of the body systems and may increase resistance to disease. However, no claim can be made about the efficacy of any advice given.
All changes are implemented at the client’s risk and they are responsible to conduct appropriate risk and impact assessments.
If the client choose to try any medications, supplements, herbal medicines, homeopathic remedies, other alternative remedies, or restrict certain foods from their diet - ENSURE that it is done so in conjunction with the appropriate medical professional, including and not limited to their GP. Any health conditions the client may have, prescription medication, over the counter medication, supplements or other remedies can cause serious interactions which is why it is important for the client to talk to their GP, physician before implementing changes to their health and wellbeing.
3. Personal Responsibility
By using and engaging with our online courses and website information, the client agrees to take full responsibility for their own health and wellbeing decisions.
The client acknowledges that any changes they make based on information from Elixir Coaching, is made voluntarily and at their own risk.
The client understands that outcomes may vary from person to person, and Elixir Coaching makes no guarantees about the effectiveness or results of any guidance provided.
4. No Liability and Limited Liability
To the fullest extent permitted by law:
Elixir Coaching accept no liability for any loss, injury, or damage incurred by the use of our information, products and materials .
Elixir Coaching shall not be held liable for any indirect or consequential losses, or any decision the client makes based on the content of our health and wellbeing information, products and materials.
Elixir Coaching’s liability for any claims arising from the use of our health and wellbeing information, products and materials shall be limited to the purchase price paid for the product or service.
5. Intellectual Property
All content from the coaching sessions, coaching materials, online courses, digital products, website content and materials, newsletters, promotions and other other correspondence; (including but not limited to text, graphics, layout, and design) is the property of Elixir Coaching and Melissa Anne de Vere-Loots, registered Sole Trader and owner and founder of Elixir Coaching, and is protected by UK copyright and intellectual property laws.
The client may use the content for personal, non-commercial purposes only. The client may not copy, share, resell, or distribute any part of the information, products and materials without prior written permission from Elixir Coaching.
6. Refund Policy
Refunds are in line with the 14 day cooling off period as per the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and Consumer Rights Act 2015. Details of Elixir Coaching’s Cancellation and Refund Polices and related exceptions are detailed below and are also to be found with the Elixir Terms and Conditions which are available at the point of checkout and are on the Elixir website.
6.1. Online courses & 14 day consumer protection rights
You have the right to cancel your purchase of an online course(s) within 14 days of payment (part or full), in accordance with consumer protection laws. Elixir Coaching required you to provide notice in writing at any time up to 14 days after the payment of your deposit or first instalment or when settled in a single, full and final payment: the earliest date of these three is the date from which the 14 days should be calculated. Notice is to be provided to Melissa Anne de Vere-Loots, owner and founder of Elixir Coaching to the email:melissaannedevere@gmail.com.
In this circumstance, the Attendee / Client will receive a full refund. The refund will be paid into the account that the initial purchase was made.
6.2 Exceptions
Unless the Online course is corrupted and cannot be accessed or is not as described, then please contact us within 14 days of purchase at melissaannedever@gmail.com and we will provide a replacement or refund as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and Consumer Rights Act 2015.

Elixir Coaching Cancelling and or Re​booking a coaching session

If your circumstances change and you need to cancel and rebook - please ensure you do this at your earliest convenience. While Elixir Coaching will do all we can to accommodate our clients, Online coaching sessions may be chargeable if not cancelled 24 hours in advance / will be deducted from your package. We would always hope to assist you and find another suitable time, but if you do not cancel and / or reschedule, 24 hours in advance of this session that will mean that other clients do not have the opportunity to book that time slot. Please discuss any extenuating circumstances with us so we can do our best to help you.
